Global Artist Residency
Program Terms

 
 

These Program Terms apply to all applicants to the TED & POSCA Global Artist Residency and supplement the FAQ. By submitting an application, you confirm that you have read and agree to these terms.

1. Organizers

The residency is organized by TED Conferences, LLC, 330 Hudson Street, 11th Floor, New York, NY 10013, in collaboration with uni Brands Corporation (POSCA) and Fine Acts. References to the organizers mean TED, POSCA, collectively.

2. Governing Law & Jurisdiction

These terms and any dispute arising from the application process or the residency program are governed by the laws of the State of New York, without regard to conflict of laws principles. The parties submit to the exclusive jurisdiction of the state and federal courts located in New York, New York.

3. Program Modification & Cancellation

The organizers reserve the right to modify, postpone, suspend, or cancel the program or any element of it (including timelines, honorarium amounts, and the number of selected artists) at any time, at their sole discretion. Updated terms will be posted on this page. No compensation is owed to applicants who have not executed a residency agreement.

4. Eligibility & Disqualification

Eligibility must be maintained throughout the selection process. An applicant or selected artist may be disqualified if they:
– provided false or materially incomplete information in their application;
– become subject to comprehensive U.S. sanctions or equivalent restrictions after applying;
– become an official, employee, or agent of a government entity or political party after applying;
– are found to have infringed third-party rights in their application materials or proposed project; or
– engage in conduct that TED reasonably determines is inconsistent with TED's values or Code of Conduct.

Where a residency agreement has been executed, its terms govern. Where no agreement has been executed, no honorarium or other compensation is owed.

5. Data Protection

Your personal data will be processed by Fine Acts and TED Conferences, LLC as independent data controllers for purposes connected to this application process. Data may be transferred to and processed in the United States and other countries subject to appropriate legal safeguards. Unsuccessful applicants' data is retained for 12 months (or up to 4 years with opt-in consent). You may request access, correction, or deletion by contacting Fine Acts at hello@fineacts.co or TED at privacy@ted.com. EU/UK applicants may also contact their local data protection authority. 

6. Intellectual Property & Moral Rights

Artists retain ownership of their artwork. By applying, and as a condition of selection, artists grant TED, POSCA, and Fine Acts a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, display, and distribute documentation of the work (photographs, video, written materials) for purposes connected to the residency, with artist credit. To the extent permitted by applicable law, selected artists agree not to exercise moral rights in a manner that restricts the organizers' use of documentation under this license. Artists are solely responsible for clearing any third-party rights in their work and its documentation.

7. Independent Status

Participation does not create an employment, agency, joint venture, or partnership relationship between any artist and TED, POSCA, or Fine Acts. Artists are independent practitioners responsible for their own tax obligations, insurance, and legal compliance.

8. Limitation of Liability

To the maximum extent permitted by applicable law, the organizers shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the application process, the selection decision, or the residency program. This limitation does not apply to liability that cannot be excluded under applicable law.

9. Entire Agreement

These Program Terms, together with the FAQ and the residency agreement (for selected artists), constitute the entire agreement between the parties regarding the subject matter herein. In the event of conflict, the executed residency agreement prevails over these Program Terms, and these Program Terms prevail over the FAQ.
